Just where this thing ends is anyones guess but the US Patent Office has dealt a severe blow to Blackboard’s already shaky patent claims. The U.S. Patent and Trademark Office (USPTO) in late March took “non-final” action that deemed all of Blackboard’s 44 patents invalid.

In case you were not plugged in, Blackboard and Canadian e-learning software company Desire2Learn have been slugging at it since Blackboard was granted patents (some say dubiously). It still remains to be seen what the jury in Texas will do as this case is by no means over.
